Most freelance jobs don't fall apart over money or quality. They fall apart in the dead space between "yes, those dates work" and an actual signed contract.

If you're working day-rate, your contract has to do more than just "be legal." It has to enforce your schedule.

Your most valuable asset isn't the work. It's the date.

If a client books you Monday to Wednesday and cancels Sunday night, a generic services agreement won't always protect that income. You need a day-rate-specific contract.

The 5 Essential Clauses for Day-Rate Freelancers

1. The Cancellation Tier (Your Safety Net)

Don't have a vague "cancellation fee." Agencies deal with shifting budgets every day; they expect you to have a policy. A sliding scale is the most professional way to handle it.

  • 48+ hours notice: 0% fee. (You're a partner, not a vendor.)
  • 24–48 hours notice: 50% fee. (Covers the scarcity cost of the jobs you turned down.)
  • < 24 hours notice: 100% fee. (At this point you can't fill the slot. You have to be paid.)

2. The Pencil Hold Policy

Define what a Pencil is. In the creative industry, a Pencil is a non-binding expression of interest. Your contract should state that any Pencil can be challenged by another client. See the full breakdown in why the Pencil Hold is a scam.

3. Payment Terms (Net 14, not Net 30)

You aren't a bank. Don't let global agencies float their cash flow on yours. For day-rate work, Net 14 should be your standard. If they push for Net 60, raise your rate. The math on why Net 30 quietly costs you thousands is in Net 30 is an interest-free loan you never agreed to give.

4. Usage and Licensing (The Real Lever)

In a day-rate world, the work is yours until it's paid for. My contract states it plainly: "License for use is granted only upon receipt of full payment." If an agency has ghosted your invoice but is running your edit on TV, they're technically infringing. That's the lever you don't want to need — and the one you'll be glad you have.

5. Scope Creep and "Hidden" Days

If a 3-day edit turns into a 5-day edit because the client didn't have their assets ready, who pays for those extra two days? Your contract should state that any day spent waiting for assets or feedback is a billable day.

SIMPLIFIED FREELANCE SERVICES AGREEMENT

1. SERVICES & DATES
The Artist (Adam) agrees to provide [Service Name] for the Client on the
following dates: [Insert Dates]. These dates are considered "Hard Booked"
upon signature of this document.

2. FEES & PAYMENT
The Day Rate for this project is $[Rate]. Total estimated fee: $[Total].
Payment terms are Net 14 days from the date of invoice.
License for use of the Work Product is granted ONLY upon receipt of full
payment.

3. CANCELLATION POLICY
If the Client cancels the booking with:
- More than 48 hours notice: No fee.
- 24 to 48 hours notice: 50% of the total estimated fee.
- Less than 24 hours notice: 100% of the total estimated fee.

4. THE "PENCIL" SYSTEM
Any dates held without a signed agreement are considered "Pencils." The
Artist reserves the right to challenge any Pencil if another client offers
a Hard Booking. The Client will have 24 hours to confirm or release.

5. OVERTIME & SCOPE
A "Day" is defined as 8 hours. Any additional time will be billed at 1.5x
the hourly rate. Any delays caused by the Client (missing assets, late
feedback) that extend the project duration will be billed at the standard
Day Rate.
